ATRIVITY PRIVACY POLICY


The following Privacy Policy applies to the Atrivity application ("APPLICATION") downloaded or accessible from any store or distribution platform (such as Apple App Store or Google Play) where the application is available.

This Privacy Policy may be changed and updated without notice. Changes will be posted in the APPLICATION and will be effective from the time of posting. By using the application, you agree to the Privacy Policy in effect at the time.

The access, download and use of the application is free except for the cost of the connection through the telecommunications network provided by the access provider contracted by the users.


1. Data Protection and Privacy

The APPLICATION will use Google Analytics and Microsoft AppCenter as a tool to know usage and interaction trends. APE SOFTWARE COMPONENTS, S.L. (hereinafter Compettia, Barcelona Trade Register, Sheet B-109267 Volume 42960 Folio 89, with CIF B60516291 and registered office at Avda. Alcalde Barnils, 72 2ºB, Sant Cugat del Vallés, Barcelona, Spain) may use the personal information you provide in a dissociated manner (without personal identification) for internal purposes such as the preparation of statistics. The APPLICATION may collect, store or accumulate certain non-personal information regarding its use.

In accordance with the provisions of the current regulations on personal data protection, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD), we inform you that the personal data provided through the acceptance of this Privacy Policy and the Terms and Conditions, will be part of a file that is the responsibility of Compettia and that these will be treated with the contracted purpose and will be kept for the duration of the contractual relationship that is the object of the use of the APPLICATION, with the sole objective of facilitating the introduction of improvements in future versions of the APPLICATION, the treatment of information on the installations, user accesses, demographic data, screens and user interaction and blockages and exceptions may also be carried out. It is also informed that you may withdraw your consent at any time and exercise your rights of access, rectification, deletion, portability, limitation and opposition by contacting Av. You may also file a complaint with the Control Authority (www.agpd.es) if you consider that the processing does not comply with the regulations in force.

Compettia reserves the right to make, at any time and without prior notice, modifications and updates to the APPLICATION. Likewise, it also reserves the right to modify the present privacy policy with the aim of adapting it to possible legislative novelties and changes in the APPLICATION itself, as well as to those that may derive from the existing codes of conduct in the field or for strategic or corporate reasons. The Client and its users accept that Compettia stores the necessary identification data (e-mail, password, name, surname and alias, optional customizable image), as well as the necessary permissions of the application (specified and of necessary acceptance during the process of installation of the application), to be able to enjoy the Services provided by the application. The Customer and its users also accept that their Alias in the system, Name and Surname, and optionally their image, supplied to the system, are visible in the system by the rest of the users of the same, always in a context limited to the Customer's environment. On the other hand, Compettia undertakes not to transmit to third parties the user's private or corporate data (email, password, and any data from the mobile device where the application is installed) stored in the application's support systems, except for legal obligations or those entities linked to Compettia as those in charge of the processing, as long as the compliance with the current regulations on data protection and information security is guaranteed, as well as the compliance with the current legislation for the processing of private data.

The User may receive notifications from the APPLICATION, with information regarding the challenges in progress, the individual or team ranking, as well as other notifications regarding the deadlines for launching new challenges to Users.

The data provided by the User in the APPLICATION will be visible in the application, so that it is possible to search among Users of the application to launch new challenges, as well as the position of the User in the individual or team ranking (including the percentage of challenges won), so that they are eventually visible by the rest of Users. The User shall not make any use of the published data of other Users beyond the pure recreational and educational use for which the APPLICATION is intended, and always within the APPLICATION.

The personal or corporate data of the Users entered in Compettia or related to the challenges will be kept as long as their account remains active.

To exercise their rights of access, rectification, cancellation and opposition, the User can contact the "Data Protection and Privacy Department", with the same address as Compettia or send an e-mail to support@compettia.com , with the reference Atrivity Account in the subject.


2. Jurisdiction and applicable law

All questions that may arise between Compettia and the User regarding the interpretation, compliance and validity of the Privacy Policy shall be governed by its own clauses and, insofar as they are not provided for, in accordance with Spanish law.
