These Terms and Conditions govern the download, access to and use of the Atrivity mobile application (hereinafter, the "Application"). The platform allows gamification, training, communication and engagement programmes to be managed, including, depending on the configuration contracted, content, questionnaires, challenges, competitions, rankings, teams, badges and progress metrics.
Compettia develops, maintains and licenses the Application. The Client contracts a specific environment, provides or validates the content, determines the authorised users and establishes the organisational, training or communication purposes for which it is used.

The specific conditions of the Main Agreement prevail over these Terms where they expressly govern the same matter.
Accessing and using Atrivity implies acceptance of these Terms. The user declares that they have sufficient legal capacity and that they have been authorised by the Client. Where access takes place in the context of an employment, professional, educational, membership or commercial relationship, the user must also comply with the Client's internal policies and legitimate instructions.
The Application may be downloaded free of charge, without prejudice to the costs of internet connection, telecommunications or devices borne by the user or by the Client.
The features available depend on the configuration and the plan contracted. The Client may organise challenges, training programmes, teams, rankings and other engagement dynamics.
The alias, the optional profile picture, the team, results, scores and ranking position may be visible to other users within the same environment where this is necessary for the dynamics that have been configured. First name, surname and email address are not shown to other users in the Application.
Scores and rankings serve an informational, recreational or training purpose. They must not be used on their own to take decisions producing legal effects or significantly affecting the user, unless the Client has expressly provided for this, has given notice of it and has an appropriate legal basis.
The user must have a compatible device, a supported operating system version and an internet connection. The applicable technical requirements are stated in the app store, in the service documentation or within the Atrivity environment itself.
Atrivity requests only those device permissions necessary for the features that are enabled, such as notifications or the selection of a profile picture. Permissions can be managed from the device settings. Denying a permission may limit the associated functionality.
Compettia makes reasonable efforts to maintain the availability of the service. Interruptions may occur due to maintenance, updates, technical incidents, electronic communications, third-party services, force majeure or circumstances beyond its reasonable control.
The user undertakes to use Atrivity lawfully, diligently and in accordance with its purpose. The following is prohibited:
No objectionable content or abusive behaviour towards other users will be tolerated. Breach of these rules may result in the removal of the content and in the suspension or cancellation of the account in accordance with section 13.
Anyone uploading a profile picture, alias, comment, training material or other content warrants that they hold the necessary rights and authorisations and that such content does not infringe the law or the rights of third parties.
The user and the Client grant Compettia a non-exclusive, limited and royalty-free licence to host, reproduce, technically adapt and display such content solely for the time and to the extent necessary to provide the service.
If the user considers that any content made available in the Application is offensive or inappropriate, or infringes their rights, they may report it to support@compettia.com. Compettia will investigate the report and, where appropriate, will remove the content or restrict access to it as promptly as possible, without prejudice to any action to be taken by the Client responsible for the environment.
Atrivity may send notifications relating to challenges, content, deadlines, results, rankings, security incidents or relevant changes to the service. The user can manage notifications from their device, without prejudice to essential communications being sent by other means authorised by the Client.
No third-party marketing communications will be sent unless there is an appropriate legal basis and the corresponding information has been provided.
The rights in Atrivity, its software, design, trade marks, documentation, databases, structure and technical elements belong to Compettia or to its licensors. Contracting the service grants a limited, non-exclusive, non-transferable and revocable right of access and use for the term of the service.
Content provided by the Client remains the property of the Client or of its legitimate owners. The Client warrants that it holds the rights necessary to upload such content to Atrivity.
Compettia or the Client may suspend or cancel an account where the relationship enabling access comes to an end, where there is a breach, where a security risk is detected, where an authority so requires, or where it is necessary in order to protect other users or the service.
Termination of access does not affect obligations that are intended to survive, in particular those relating to confidentiality, intellectual property, liability and the statutory retention of data.
Downloading from the Apple App Store, Google Play or other platforms may additionally be subject to their own terms. Atrivity may include links to or integrations with third-party services, whose terms and policies must be reviewed separately.
Compettia may release updates in order to fix errors, improve security, adapt the Application to technical or legal changes and add new features. Certain older versions may cease to be supported where this is reasonable and notice is given by appropriate means.
Atrivity is provided with the professional diligence required and in accordance with the features contracted. Compettia does not warrant the complete absence of interruptions or errors, but will take reasonable measures to prevent and correct them.
Compettia is not liable for damage arising from use contrary to these Terms, from the user's devices or networks, from the Client's content or instructions, from third-party services or from causes beyond its reasonable control. None of the foregoing limits liability that cannot lawfully be excluded.
The processing of users' personal data is described in the Atrivity Privacy Policy. Where the Application is used as part of a programme contracted by a Client, that Client acts as controller and Compettia as processor, on the Client's behalf and in accordance with its instructions.
Compettia may amend these Terms in order to adapt them to legal, technical, functional or security changes. The version in force will be published through the corresponding link, stating the date of the update. Where changes are substantial, notice will be given by appropriate means.
These Terms are governed by Spanish law, without prejudice to any applicable mandatory rules. Disputes will be submitted to the courts and tribunals provided for in the Main Agreement and, failing that, to those of Barcelona, unless a mandatory rule provides otherwise.
